Read The Actual Notice Immediately

Texas DPS generally provides 15 days after an ALR notice is served to request a hearing. For certain notices sent after consensual blood-test results, DPS describes 20 days from mailing. These are different notice situations: do not assume every case has the same deadline or that a court date extends it.

ALR And Criminal Court Are Separate

An ALR hearing addresses the administrative suspension or disqualification of driving privileges. It is separate from the prosecution of the DWI charge. Preparing for one process does not automatically resolve the other. The State Office of Administrative Hearings conducts ALR hearings before an administrative law judge.

If the suspension notice followed a declined test, read what to know after refusing a breath or blood test in Houston.

What A Hearing Can Involve

The applicable issues depend on whether the allegation involves test refusal or a qualifying test result. The stop, arrest, requested specimen, notice, and supporting records may matter. Leslie can review the documents, identify disputed issues, and explain the hearing process in the context of your criminal defense.

Driving, Work, And License Status

Do not assume that holding a physical license means you may legally drive. Check your current eligibility and follow applicable restrictions. Occupational-license eligibility is case specific and should be discussed separately, especially when commercial driving is involved.

Frequently Asked Questions

Should I wait for my DWI court date?

No. Have the license paperwork reviewed promptly. A separate hearing request deadline may expire before that court date.

Does winning an ALR hearing dismiss the DWI?

No. The administrative and criminal matters are separate proceedings.
